Cancellation and Refund Policy
1. Cancellation and Refunds
1.1
You have the right to cancel the contract for products (other than plants and food) within 14 days without giving any reason. You cannot cancel the contract for plants and food if you change your mind because they are perishable.
1.2
The cancellation period will expire after 14 days from the day on which you acquire, or a third party specified by you (other than our delivery partner) acquires, physical possession of the products. For these purposes you will be considered to have acquired the products if they have been delivered to a place or person specified by you in your order, or to a place or person notified to our delivery partner if you are not at home when the products are delivered.
1.3
To exercise the right to cancel, you must inform us at Leafwise, Whitacre Garden Centre LTD, Campden Road, Stratford-upon-Avon, CV37 8LW, of your decision to cancel this contract by a clear statement (e.g. a letter sent by post) or you can e mail us at: mail@leafwise.co.uk. You may use the attached model cancellation form, but it is not obligatory.
2. Effects of cancellation
2.1
If you cancel the contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
2.2
We may make a deduction from the reimbursement for loss in value of any products supplied, if the loss is the result of unnecessary handling by you.
2.3
We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any products supplied.
2.4
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
2.5
We may withhold reimbursement until we have received the products back from you or you have supplied evidence of having sent back the products, whichever is the earliest.
2.6
If you have received products:
- 2.6.1 you must send back the products, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of the contract to us. The deadline is met if you send back the products before the period of 14 days has expired.
- 2.6.2 you will have to bear the direct cost of returning the products; and
- 2.6.3 you are liable for any reduction in the value of the products resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the products.
2.7
If you are returning garden furniture or large products you must ensure that they are properly packed and safely shipped so that they are not damaged during their return to us. We suggest you use a reputable courier.
